Terms of Service

These Terms of Service govern your use of the BestBuyReview website at www.bestbuyreview.net (the "Site") and of the services described on it (the "Services"). BestBuyReview is a brand operated by Achat Avis, a company based in Île-de-France, France ("Achat Avis", "we", "us", or "our"). You can contact us at contact@bestbuyreview.net.

By using the Site, submitting a form, or ordering a plan, you accept these terms. If you act for a business, you confirm that you are authorized to bind that business, and "you" or "Client" refers to it. If you do not accept these terms, please do not use the Site or the Services.

In these terms, the following words have the meanings below.

• "Customer" means a person who completed a real purchase, booking, appointment, project, or visit with the Client.
• "Campaign" means a review invitation or feedback program that we set up and run for the Client under a plan or the free offer.
• "Platform" means a third-party review site or app store, such as Google Business Profile, Facebook, Trustpilot, Yelp, Tripadvisor, Amazon, the App Store, or Google Play.
• "Customer Data" means the Customer records the Client shares with us so that a Campaign can verify customer events and deliver messages.

We provide verified-customer review invitation campaigns and related reputation services for businesses in the United States. A Campaign starts from a completed Customer event, sends that Customer a neutral message with a direct link to the Client's review profile, and reports on delivery and responses. Depending on the plan, the Services also include a performance dashboard, a dedicated account manager, local-SEO guidance for the Client's listing, help with replies to reviews, CRM and business-tool integration, and support for several Platforms.

Customers decide whether to respond, what to write, and which rating to give. We therefore do not guarantee that any Customer will publish a review, nor the number, content, rating, or timing of reviews. Platforms decide on their own whether to publish, filter, or remove content, and we do not control those decisions.

No reviews are sold, written, or compensated through BestBuyReview. Specifically, we do not:

• Sell reviews, write reviews, or suggest the wording or rating of a review.
• Offer, or help the Client offer, payment, discounts, gifts, contest entries, or any other incentive in exchange for a review.
• Post reviews from accounts we or the Client control, or invite employees, relatives, partners, or other people with a conflict of interest.
• Screen Customers by expected sentiment before inviting them, a practice often called review gating.
• Send review requests on Platforms that ask businesses not to solicit reviews, such as Yelp. For those Platforms, the Services are limited to page optimization, private feedback follow-up, monitoring, and responses.

Campaigns are designed to comply with the U.S. Federal Trade Commission's Trade Regulation Rule on the Use of Consumer Reviews and Testimonials, 16 CFR Part 465, and with the review policies of each Platform. These rules change over time, and we may adapt a Campaign's wording, timing, channel, or scope to keep it compliant.

We may refuse, pause, or stop any Campaign, message, or instruction that we reasonably believe would breach the law, a Platform policy, or these terms. Doing so is not a breach of our obligations. Information on the Site about laws and Platform policies is general information, not legal advice.

When you use the Services, you agree to:

• Share only Customer Data relating to real Customers with a completed purchase, booking, appointment, project, or visit.
• Invite every eligible Customer the same way, without selecting Customers by expected sentiment, satisfaction score, or survey answer.
• Not offer any incentive tied to a review, not discourage negative reviews, and not ask Customers for a particular rating or wording.
• Hold the rights and, where required, the consents needed to share Customer Data with us and to contact Customers by email or text message, including under the CAN-SPAM Act and the Telephone Consumer Protection Act where they apply.
• Honor Customer opt-out requests promptly and tell us about any opt-out you receive directly.
• Give accurate information about your business, your listings, and your Customer volume, and approve each message before it is sent.
• Share only the Customer Data needed for the Campaign, and never sensitive data such as health, financial account, or government identification information.

You remain responsible for your own business practices, for the content you publish, and for your replies to reviews.

New Clients may request a first Campaign with 5 free verified-customer invitations, without a credit card. The offer is limited to one per business, follows the same rules as paid Campaigns, and does not commit you to a paid plan. We may decline or end the offer for any request that does not meet these terms.

Plans and prices are those shown on the pricing page on the date of your order: Starter at $199 per month (30 verified customer invitations per month); Professional at $349 per month (60 verified customer invitations per month); Enterprise at $599 per month (90 verified customer invitations per month). Prices are in U.S. dollars. Applicable taxes, if any, are added as required by law.

Plans are billed monthly, in advance, for each monthly period, using the payment method agreed when you order. Invitations included in a monthly volume are not carried over to the next month unless we agree otherwise in writing. Plan-specific benefits, such as a discount on a next order, apply as described on the pricing page at the time of your order.

We may change our prices for future periods. We will inform active Clients by email at least 30 days before a price change applies to them, and you may cancel before the new price takes effect.

Every plan includes one guarantee, the campaign launch guarantee: if we cannot launch your campaign within the agreed timeframe, your first month is refunded. The launch timeframe is agreed with you when the Campaign is set up.

The guarantee does not apply when the delay is caused by the Client, for example missing Customer Data, an unapproved message, missing access to a listing, or a request to postpone, or by a Platform decision outside our control. It covers our setup and launch work only. It is not a guarantee of reviews, ratings, rankings, or business results. To claim it, email us within 30 days of the agreed launch date.

Plans run month to month with no long-term commitment. You can cancel at any time by email to contact@bestbuyreview.net. Cancellation takes effect at the end of the monthly period already paid, and the Campaign continues until then. Apart from the campaign launch guarantee, fees for a period that has started are not refunded.

We may suspend or end the Services, with notice where reasonably possible, if you breach these terms, fail to pay, or ask us to act in a way that would breach the law or a Platform policy. At the end of the Services, we stop sending messages and handle Customer Data as described in section 11.

Our Privacy Policy explains how Achat Avis handles personal data as a data controller, for example the details you send through our forms.

When we process Customer Data on your behalf to run a Campaign, we act as your processor. We use Customer Data only on your documented instructions and for the Campaign, keep it confidential, protect it with appropriate security measures, use only service providers bound by equivalent obligations, help you answer data-subject requests, and delete or return it at the end of the Services unless the law requires us to keep it. You remain the controller of Customer Data and are responsible for the lawfulness of sharing it with us.

The Site, its text, guides, graphics, logos, and structure, and the BestBuyReview name are owned by Achat Avis or its licensors and are protected by intellectual property laws. You may read and share links to our pages, but you may not copy, republish, or reuse substantial parts of the Site without our written permission.

You keep all rights in your brand, listings, and Customer Data. You grant us a limited right to use them only to provide the Services. Reviews belong to the Customers who wrote them and are governed by each Platform's terms.

You agree not to misuse the Site, including by sending false or misleading information through our forms, submitting someone else's details without permission, attempting to break or overload the Site, or using automated tools to collect its content in a way that harms its operation.

The Services work with Platforms that we do not own or control, and the Site links to official policies and other third-party pages. Each Platform applies its own terms, may change its rules or features at any time, and may filter or remove content at its discretion. We are not responsible for third-party sites, their content, or their decisions.

We provide the Services with reasonable care and skill. Except as expressly stated in these terms, the Site and the Services are provided as available, without any other warranty, express or implied, to the extent permitted by law. We do not warrant any particular number of reviews, rating, search ranking, traffic, or revenue.

To the extent permitted by law, Achat Avis is not liable for indirect or consequential losses, such as lost profits, lost revenue, loss of goodwill, or the consequences of a Platform's decision about content. Our total liability for any claim relating to the Services is limited to the fees you paid for the Services in the three months before the event giving rise to the claim.

Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by negligence.

You agree to compensate us for losses, fines, and reasonable costs arising from third-party claims caused by Customer Data you shared without the necessary rights, by instructions you gave in breach of these terms, or by incentives or other practices you applied outside the Campaign.

We may update these terms, for example to reflect new laws, Platform policies, or services. The date at the top of this page shows the latest version. For active Clients, material changes take effect 30 days after we notify them by email; continuing to use the Services after that date means you accept the updated terms.

These terms are governed by French law. Before going to court, please contact us at contact@bestbuyreview.net so that we can try to resolve the dispute amicably. Failing an amicable solution, the courts of Paris, France, have exclusive jurisdiction for disputes between businesses.

The Services are intended for businesses. If you nevertheless use the Site as a consumer, these choices of law and court do not deprive you of the protection of the mandatory rules of your country or state of residence, and you may bring proceedings before the courts that have jurisdiction under those rules.

These terms, together with the pricing page and any written order confirmation, form the entire agreement between you and us about the Services. If a provision is found invalid, the rest of the terms remain in force. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these terms without our consent. These terms are written in English; a translation, if provided, is for convenience only.
